African Bank are finding it difficult to send Debt Counsellors Termination letters and would like Debt Counsellors to make it easier and more cost effective from them.

RE: CONSENT TO RECEIVE S86(10) TERMINATION NOTICES VIA E-MAIL / FAX

 

We refer you to the North Gauteng High Court judgment of Standard Bank v Wessels handed down on the 20th of April 2012.  The court directed that all termination notices must either be sent via registered post or hand delivered to the Debt Counsellor by the Credit provider.

The current process followed by Credit Providers is to forward the termination notice to Debt Counsellors by way of facsimile or electronic mail as a standard procedure.  Credit Providers deviate from this process only in instances where they are specifically requested by a Debt Counsellor to forward the termination notice by registered post.

The exchange of documentation by way of electronic mail and facsimile on the side of the Debt Counsellor and Credit Provider is done in order to expedite the finalization of the Debt Review process.  The ruling in terms of the judgment is overly burdensome on Credit Providers in that a cost is involved in forwarding a letter by registered mail and a duty is placed on the Debt Counsellor to visit the post office on a daily basis to collect their registered post.

In light of the above, we humbly request you forward us a letter on your business letter to this effect.
