The NCR gives DCs a week to change from CPE

The National Credit Regulator recently decided not to renew the Service Level Agreement to be a Payment Distribution Agent to CPE. CPE or Consumer Protection Excellence has been operating as a PDA for several years now under licence from the NCR. In their letter to Debt Counsellors about their decision they have indicated that the effected DCs have to switch to a different Payment Distribution Agency and inform them of their choice of new PDA by the 8th of July (Monday next week).

The NCR have further said that should the Debt Counsellor fail to inform them they will take it upon themselves to choose a new PDA for the Debt Counsellor. It is unclear of the legal ramifications of such a statement as the NCR then might be held liable for possible future losses suffered by consumers or Debt Counsellors should something go wrong with that particular service provider. It seems unlikely that the NCR will be able to enforce such a statement. The intent is clear though. The NCR want the effected DCs to make a choice and fast.

 

There is much concern about the additional workload the forced shift will create for Debt Counsellors and the possibility that this could cause trouble for consumers.

CPE themselves recently communicated with current Debt Counsellor users (who make use of their system) that they have brokered a deal with NPDA (another licensed PDA) to transfer over files on the EMINENCE system to their care.

 

Here is part of their correspondence:
CPE will integrate Eminence with NPDA from the first of July 2013. This will imply that you as debt counsellor will not be influenced by this transformation. Eminence support will be provided by HVDM Software and thus be serviced by ourselves. 

CPE will advise all consumers of the new banking details and request that you assist us herein. All funds received in the CPE bank accounts will be distributed by NPDA after integration. Up until then CPE will conduct the distributions as normal. 

CPE have asked that if any consumer or Debt Counsellor has any concerns that they contact CPE staff at once for assistance.
