We recently published an article regarding the Michael Tellinger Case, recently held in the High Court. You will recall he tried to appeal the judgment but the judge who got to decide if there could be an appeal was the same judge who gave the ruling. Remember?

As this is an extremely important case, one which the New ERA – a NPO – is considering supporting, it is therefore of great interest to them to get some feed back from the public.

Michael Tellinger is now taking this argument to the Constitutional Court and, as such, its merits should be considered.

 

 

 

Now New ERA would like you to contact them to comment on three aspects of the M&G article:

1. “It took Judge Jackson Mabesele only minutes to deliver his judgment.”

As mentioned in our previous letter, the lightning speed of the decision made by the judge is of concern to the NPO. Michael Tellinger delivered a substantial argument and made serious allegations against the banks

2. “…his conduct “amounts to abuse of court”. This… raises the prospect of him being declared a vexatious litigant and barred from the courts.”

It is sad that Mr Tellinger could receive such harsh retribution. Naturally, the NPO fully supports the court in protecting the justice system… but protecting the system from what?… a lone man standing up for himself against the banks?

As such, we need to ask the crisp question… Could this be an infringement of Mr Tellinger’s rights?

3. “What does he take us for?” fumed the bank’s senior counsel, Shem Symon, a man colleagues say is not in the habit of losing his cool in court. “It is not he who has been violated; it is us … We are the innocent party here, having given him money in good faith and having received nothing but contempt and insults.”

To conclude, Mr. Tellinger is approaching the Constitutional Court and takes with him the plight of millions of South Africans.
