It seems that ABSA have received a bloodied nose from Ex Navy Captain Teboho Molotsi with a bit of help from Debt Counsellor Derry Burge.

Mr Molotsi settled his bond repayments years early and was happy till the bank said they were giving him some money back for the early repayment but actually were trying to reactivate his bond and give him access to credit again.

Next ABSA tried to take his house from him and then the fight was on. In a recent High Court decision Mr Molotsi defended himself (after ABSA seemingly poached his attorneys) and with some NCA advise from Debt Counsellor Derry Burge gave ABSA a thumping for all sorts of things including not doing an affordability assessment or getting Mr Molotsi to sign new credit contracts.

ABSA had to foot the bill for the whole thing and the court ruled in the favour of the consumer. This just goes to show that with some good preparation consumers can represent themselves at this level and win.
