NCT deregister 2 naughty (now ex) Debt Counsellors
Lazy or Lying Debt Counsellors deregistered
The National Credit Tribunal (NCT) has at the request of the National Credit Regulator (NCR) de registered two former Debt Counsellors Liezl de Klerk and Charmaine Moonasamy.
Who they are and what they did…or didn’t do
So what gets a Debt Counsellor De registered? Well it is normally what they are not doing. If the NCR gets a lot of complaints about a Debt Counsellor they will send staff to visit their office and investigate in person.

“The debt counsellor failed to comply with the provisions of the NCA, its regulations, as well as her conditions of registration as a debt counsellor,” said Obed Tongoane, NCR chief operations officer.
In particular taking funds from clients directly was in contravention of her conditions of registration. She also had bad record keeping and did not refer matters to court. This leaves consumers exposed.
Charmaine Moonasamy
(Practised in Lenasia South in Johannesburg but moved to Chatsworth, Durban)
Lied to the NCR when applying to be a Debt Counsellor. In particular it seems she was under an administration order herself when applying to become a Debt Counsellor. This disqualifies her. Since she lied and did not qualify her registration was invalid. Also she took money directly from clients.
It could even be the case that one or both former Debt Counsellors have to pay some funds back to the effected consumers. This will be decided in the near future.
Clients of these two former Debt Counsellors will now be handed over to another counsellor or counsellors. the NCR is traditionally very secretive about who will take over these cases.
Warning Signs
If your Debt Counsellor has not sent your debt review matter to court yet or is taking money directly from you there may be a problem. Talk to the NCR about such matters.
